Obviously he's pretty silly to do this. The will is clear and treating all your children equally would be the normal and reasonable thing to do, so I would suggest he's guaranteed to lose.

The executor can take their legal fees out of the estate. Not that child's share, just the estate, so all the beneficiaries get less. The executor never has to pay out of their own money as they aren't personally being sued, they're just doing their job and they shouldn't lose out from helping their dead friend or relative. They COULD always ask the judge to order that these costs come specifically out of that child's share, though that may not work. It never hurts to try. At worst, the judge can only say no. (Personally I'd grant that application, but I'm not a probate court judge!)

I am reminded of "Bleak House" by Charles Dickens. A big theme of the book is the inheritance case in the Court of Chancery of Jarndyce v Jarndyce. Dickens was quite a satirist in his own way and at the time, the Court of Chancery was a byword for being slow and expensive. So he decided to have a go at it in book form. The dispute over the will went on and on and on and several hundred pages later, the case ends because the entire estate has been eaten up in legal fees. On that point, Dickens was only reflecting what really did happen from time to time.

Of course this is English law but US law is much the same, so it's still worth taking the moral of the story to heart - the only real winners in a case like this are the lawyers. I'm glad to say that over a century later, the High Court Chancery Division (as it now is) is rather more efficient!

He can contest all he likes, but he has no basis for it, so all it will do is delay the processing of the estate. He'll never get more than what the will says.

The legal fees come out of the estate in general, though the Executor may petition the judge to order such that they come out of only that share (may or may not work).

If you're about to be marked, pray the Jesus prayer. Hide with Orthodox Christians to escape 666; leave all electronics behind so that antichrist's minions can't track you. Give to charity in the name of Archangel Michael; he rescues people from temporary hell twice a year (or brings them up a level, that is, to a level with less punishment; eventually, people are freed).
