Do I have to answer the door to a cop? I have not broken a law but wish to avoid a subpoena.?

    you must show up to court if you are issued a subpoena. If you do not, you can be charged with a crime.

    Cops do not issue subpoena, an arrest is the equivalent in the penal law system, so that is a warrant and they could break in if they know you are actually home. If for some reason there is a subpoena in a case, it could be served by a sheriff and then you don't have to answer the door. Must times they will sent it by mail and then you don't have to answer the mail man cert. letters or go sign for it. You should watch out for regular people too that are Process Servers

    It would be highly advised to answer the door. Trying to avoid it will only make things worse. If they are there to issue a subpoena, all they will do if you do not answer is mail it to you to the last known address. If the last known address that is in the system with DPS (Im in Texas) is not your current, then there is no defense to the fact that you never received the subpoena. Then, because you never got the subpoena or you never showed, you shall get confinement. All in all, it is highly advised that you answer the door. Maybe your neighbors house was on fire or there was a serious problem and they needed to get info to you. That was kind of a crappy move on your part.

    Unfortunately you can not avoid a subpoena by refusing to open the door to the police. The court will have the view that the subpoena is deemed to be served, hence they will hear the case in your absence. Sometimes corrupt police deliberately stage a situation that people do not get served with the subpoena and they orchestrate a hearing in absentia. This kind of dirty tricks are practised by the infamous Melbourne Magistrate Courts by the hanging judges.

    Actually PeterV is pretty close to right & tonalc1 is pretty close to right. If the officer, or any server, knows you are in your home, the subpoena can be left at the door & be considered legally served. TV has it wrong where the subpoena has to be handed to the person.

    It is just simpler to take it like a man! If they want you bad enough, they will get you. Would you prefer getting served at home or when you're at work? Perhaps out some night to dinner? Maybe when you are with a close friend?

    You can't avoid a subpoena. If you ignore the cops at the door, they'll just come back later with a warrant for your arrest for contempt of court.

    In most states, the cop can leave the subpoena at the door, and that is considered adequate service. It could also be served by certified mail.

    If the police officer is serving you a supoena, your best to answer the door but you don't have to. If you don't answer the door, the police officer will note that your evading a supeona and then a judge will issue a bench warrant for your arrest and you will be taken into custody and spend either a) the remainder of the persons trial or b) 8 clear days in jail. I suggest that you just take the supenoa and show up for court.

    You don't have to answer your door. However, a subpoena can also be served by certified mail, so you're not going to avoid it unless you refuse your mail as well.

    Add: Re Peter V's comment, it is not legal to just "leave" a subpoena at your door. If not by certified mail, it has to be served in person.

    You do not have to answer your door to anyone for any reason. Only time you would have to open your door for a cop is if they have a search warrant and then they will come in on their own. If they see you inside some judges will allow tem to leave it on the door because you are avoiding them. Keep your curtains closed and te tv down low. Hell my ex as avoided getting servered for child support for several years.

    Yes you do. He may also just leave the subpoena there, it's still legal and assumed served.
