I need advice on unemployment appeal! HR lied about a no call no show...?
My employer has a zero excuse 12 point attendance policy. I have a chronic health condition that I found out from my doctor should have been covered by FMLA the whole past year that I've been having issues, she brought up FMLA when I told her I was about to point out due to the condition. I didn't get covered until I was at 11 points.
February comes and the artic vortex hit our area. On the morning of February 18 I went out to start my car for work and my battery was dead, I'm sure due to the subzero temperature. I immediately called work and let them know that I was going to be late and the reason, I figured I would be able to get a ride or a jump pretty quick. I was wrong, by 6:54 I knew I wasn't going to be able to get there by 7:30 (it's a 30 minute drive on good days and the roads were still pretty bad) so I called and left another voicemail as well as text my HR manager letting her know what happened and I understood that was my final point. She texted me back and said that she was 'sorry things didn't work out' and she 'wished me the best'. I filed for unemployment and received a letter from the state saying I was denied for 602-misconduct. My employer said that I was a no call no show on February 19, the day AFTER I pointed out! I sent in my appeal already, any advice going forward would be great!
And I was with the company for 10 years and made $65,000 yr.
4 AnswersLaw & Legal2 weeks agounemployment law help...?
Because of natural disaster and road closures due to the natural disaster it now take approx 1-1.5 hours to get to work. It usually takes only 25-30 min. I called the unemployment office to see if I would qualify for disaster assistance untill the roads opened. I qualified for $379.00 weekly. I then spoke with my boss and told him that I had to take leave untill the roads open, I only gross $1500.00 a month and $160 a week for gas HURTS...I'm NOT lazy and just not wanting to work, I actually really like my job, but I also have 2 kids that I have to have $$ to support. Two weeks later, roads STILL closed, I got a call from the office manager telling me that my boss wanted my key back. Then I got a letter from unemployment saying that my boss is fighting my unemployment because I quit. I have my telephone confrence next week with UI office and are a little nervous. Any thoughts or advice? And yes, I am actively seeking new work.
1 AnswerLaw & Ethics1 decade agoI asked this earlier, but let me try to rephrase...?
IBecause of the massive flooding on the Mississippi the bridge I have to cross to get to work has closed. (I live in Illinois and work in Iowa)It took my travel time from 30 minutes one way to over 1 hour one way. After making that drive for a week, and spending $160.00 in gas, a family member who also lives in the same town I do and works in the same town I do said that she had just applied for disaster unemploymentdue to the excessive drive. I spoke with my husband, who was already stressed about how much extra $$ we were spending on gas (I only gross $1,500 a month and only get paid once a month) and decided I should do the same. I let my boss know that I just could not financially make that drive and I would just have to wait until the bridge opened. Two weeks later, bridge still closed, I got a call from the office manager telling me my boss wanted my key back. Now he is fighting my unemployment saying I quit. I understand he had to fill the position, how will unemployment see it
2 AnswersPersonal Finance1 decade agoI live in Illinois by the recent flooding and got fired for not being willing to drive twice the distance...?
I had only been at this company for 6 weeks when the big Mississippi River flood hit, causing the bridge I have to cross to get to work to close. I can still get there, but it turns my 60 mile round trip to 120 miles to take the only other route. After 1 week of making that drive (and $160 in gas later) I was told to call the unemployment office to ask about disaster help. The worker there said that I could file for disaster unemployment, so I did. I called my employer and let him know that I was not financially able to make that drive untill the bridge opens back up(I "GROSS" $1,500 monthly) which they were calling for it to be close for at least a few weeks. He had the office manager call me 2 weeks later and tell me to return my key. I just got a letter in the mail from unemployment saying that he is protesting my unemployment and saying that I quit my job. We have the telephone confrence between me, the unemployment rep., and my employer next week. Any ideas on possible outcome?
3 AnswersOther - Careers & Employment1 decade agoI lied on a job application and am now so regretting it!?
I was convicted of a felony almost 8 years ago, it was drug related. I have always been truthful on job applications about my conviction, and have also not recieved any calls from hopeful employers. A friend of mine said that background checks only go back 7 years, so I just shouldn't put it down. Well, I marked the "Have you ever been convicted of a felony?" box NO on the last application I filled out (at a company I would love to work for) I am now getting ready to go to my interview and want to tell them the truth. I regret marking that box NO so bad! Should I just come clean first thing at the interview? PLEASE no put downs about the felony, if I could go back and change it I would, but that just isn't an option.
7 AnswersLaw & Legal1 decade agoWhat is the difference between a 5 panel drug screen and a 10 panel?
I had a pre-employment drug screen thismorning and saw that there was a box for 5 panels or 10. I'm not worried how the test will come out, I know I'm clean, I'm just curious to know what the difference is. They did a 5 panel on me.
